How to Teach Summarization Skills to Elementary Grade Children

Summarizing skills must be taught to elementary students, although many teachers assume that the students automatically know how to condense the main ideas of a text. One of the main things to impart to students is that they do not have to give their own impression of what they read when writing a summary. They simply restate the main facts presented.

Present a text to the students and then show them three different types of rewritten texts. These should be a summary, a critique in which the writer presents his/her opinion about the material and a third in which the writer simply rewrites the text in his/her own words. Ask the students which one they would consider to be a summary. Discuss the critique and the rewritten piece explaining why they are not summaries. Lastly, discuss the summarization outlining the reasons that this is what a summary should look like.

The objective of the lesson is that the students will be able to effectively summarize a given text. In order to do this it is important to teach students how to identify the main idea of a paragraph. It does not necessarily have to be the first sentence of the text and could actually be the last. Ask the students to read the paragraph silently and then underline what they believe to be the topic sentence. As students give their answers, ask them why they chose this sentence.

Once the main idea sentence of the paragraph has been established, ask students to create a list of ideas in the paragraph that support this main idea. They can list them in point form, which is the simplest type of summarization. Each sentence of the paragraph will contain information supporting the topic, so students should be encouraged to find the same number of supporting ideas as there are sentences in the text.

When students can summarize a text using point form, the teacher can then teach them how to write the summary in sentences, making sure that they use third person and past tense. If the text provides directions or instructions or talks of a process of some kind, students should know how to use sequential words to show which ideas come first, second and so on. These are called transition words and ideally the teacher will already have taught a lesson on how and when to use these words. Thus a lesson on summarizing will cause the students to exercise prior knowledge in demonstrating that learning has taken place.

To evaluate how well students have understood the lesson and the level of learning that has taken place, they should be given a passage to read and summarize on their own. In this way, the teacher can determine which students need individual attention in further teaching and which ones are ready to progress with independent work.

It is important to note that this is not a lesson that one can teach and forget thinking that students will always use summarization skills when needed. It will need to be constantly revisited and retaught so that all students can feel confident in summarizing what they read.

I was just wondering what is the difference between Chapter 7, 10 & 13 bankruptcies. How did the new law that Bush passed now affect bankruptcies (or does it at all)? I’ve heard everything that you can’t file for Chapter 13 bankruptcy anymore to you have to take financial planning classes thereafter. Also, is it advisable at all? I know normally people say make it your last resort, but I am beyond in debt and do not have any other resolutions. Any horror stories after filing? Any positive stories? Please enlighten me.

I filed the week before the laws changed, but I know a little about what changed.

Ch. 7 is a liquidation, where your unsecured debts are discharged and not owed on anymore. Secured debts can be reaffirmed in some cases. This is the one that’s almost impossible to do now.

Ch. 13 is for debt restructuring. There’s a formula they use to see how much money monthly you can afford to pay back. If, when using this terrible formula created by the IRS, you can afford to repay even $ 100 per month, you must file Ch. 13 and settle out your debts, over a maximum 5 year period.

The dirty secret that no one talked about before the law changed, is that 4 out of 5 people who filed Ch. 13 BEFORE the change, failed. You miss one payment and the whole thing can get derailed. God help you if you lose a job, get injured, whatever.

There are also some “means” tests, where your income is compared to the average income for your area. If you make very little money, you may still qualify for a Ch. 7.

And yes, I believe that before anyone can file a BK now, you must meet with a non-profit credit counselor first.

Call a few BK attorneys. Get quotes on prices, and meet with a couple that are cheap but seem knowledgable. Most will give you at least a 30 minute consultation at no charge, in hopes of earning your business.

Mesothelioma Law Firm Wins Appeal

Clapper, Patti, Schweizer & Mason (CPSM) filed a wrongful death complaint on behalf of their clients, Rachel Flores and her two children, against Kmart in Superior Court. The trial court dismissed the Flores case, stating that the claim was barred because of Kmart?s reorganization plan that had been approved in April of 2003 as result of bankruptcy proceedings. (In re Kmart Corp. (Bkrtcy. N.D.Ill. 2003) 293 B.R. 905, 907.) CPSM filed an appeal, to overturn the ruling. CPSM was successful and this ruling was reversed on appeal.

According to testimony taken in preparation for filing a mesothelioma lawsuit, Martin Flores stated he was exposed to asbestos in 1989 and 1990 while performing construction work in a Riverside store operated by defendant, Kmart. Mr. Flores then developed mesothelioma, an incurable cancer caused by exposure to asbestos, and died on June 19, 2008. His wife, Rachel Flores, filed a wrongful death action on behalf of herself and her two children on December 17, 2008.

According to the National Institutes of Health, mesothelioma’s long latency period between time of exposure and development of disease does not develop is anywhere from ten to fifty years after exposure to asbestos. Asbestos exposure is a common occurrence during construction projects on older buildings, as most were constructed using asbestos containing materials until the mid-1980?s when restrictions began to be enforced.

As reflected in court documents, Kmart asserted that Flores could not file a wrongful death action because of defendant?s approved reorganization plan of 2003 that discharged all known and unknown claims. The plaintiffs argued that barring the Flores claim violated their Fourteenth Amendment due process rights as there was no evidence that Mr. Flores or his family had any notice of the 2002 and 2003 bankruptcy proceedings and furthermore there was no way that Mr. Flores could have been aware of injuries sustained at the time of the reorganization plan approval.

The California State Court of Appeals reversed the previous ruling, (Flores v. Kmart Corp. (2012) 2012 Cal. App. LEXIS 55) agreeing that it would violate due process rights, and ordered that the Flores family could indeed continue with their wrongful death action against Kmart Corporation. The case was remanded to trial court for further proceedings.
